Discord community terms

1. Overview
1) These Terms of Use define terms and conditions of online Services – eu.DEEPTECH community based on Discord’s service.
2) Terms contain the rules for concluding and terminating the agreement between the Service Provider and the Service Recipient and technical conditions for using the Service.
3) These Terms do not regulate and are not intended to be used to conclude other contracts/agreements concluded outside the eu.DEEPTECH.
4) To access the eu.DEEPTECH Service, it is necessary to have an operational account in the Discord service.
2. Definitions
1) Community – a digital/online collaboration tool that enables communities to build and exchange knowledge and networks via eu.DEEPTECH.
2) Content – means all the things User adds (upload, post, share, stream, etc.) to our Services. This includes text, links, GIFs, emoji, photos, videos, documents, or any other media.
3) Discord – software and the services provided by Discord Inc. San Francisco, CA USA. – discord.com/terms.
4) DSA – Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on the single market for digital services and amending Directive 2000/31/WW (Digital Services Act).
5) eu.DEEPTECH – online Service provided by Service Provider based on Discord service available at: discord.gg/whqRrJ8n3D.
6) Notice – notification of specific information – Content that the notifying party considers to be illegal Content to the Service Provider.
7) Provider or us/we/FundingBox – FundingBox Accelerator sp. z o. o. Postępu 15 Str. 02-676 Warsaw, POLAND mailing address: FundingBox Accelerator sp. z o. o. Dworcowa 7 str. mailbox 37, 62-020 Swarzędz, POLAND.
8) Recipient or User/you – means any natural or legal person who uses a Service, in particular for the purposes of seeking information/Content or making it accessible.
9) Service – digital/online service consisting of the storage of information (Content) provided by, and at the request of, a Service Recipient.
10) Terms – this Terms of Use eu.DEEPTECH Community Service.
3. Agreement
1) The agreement between the Provider and the User is formalized once the User acknowledges reading these Terms and gains access to the eu.DEEPTECH Service.
2) The agreement can be terminated by the User at any time by exiting the eu.DEEPTECH Service.
3) The User should keep in mind that while using the eu.DEEPTECH Service, they must adhere to the regulations established by Discord Inc. at all times – discord.com/terms.
4) The Provider offers the Service in accordance with these Terms and in compliance with applicable laws, including DSA.
5) The use of the Service is at no cost, but it is necessary for the User to have access to an internet connection and Discord’ account.
6) If you use our services on behalf of your employer or other organization, you hereby declare that you have the appropriate authorization to represent this organization to enter into an agreement with the Provider.
7) FundingBox may assign this agreement to its affiliates without your consent.
4. Scope of Service
1) Users can join and participate in eu.DEEPTECH communities;
2) Service enables Users to connect and communicate with other Users via chats, groups and posts.
3) Users may:
a) to share comments, posts, links, documents, and various other forms of Content,
b) use the Content under these Terms and conditions and the owners of the Content,
c) comment, publish, browse and chat and interact with other Users,
d) navigate through public Content, actively create the Content, make contacts, run conversations.
4) Information and Content that you share or post may be seen by other Users.
5. Rights of third parties & use your content
1) Within eu.DEEPTECH you can publish Content that might be covered by your intellectual property rights (in particular copyrights) or third party rights (for example, author of an article, graphic, photo, person who is in the picture).
2) By using our eu.DEEPTECH, you agree to provide only content or information that does not violate the law or anyone’s rights. Rights of third parties cover not only their intellectual property rights but also their image, opinion, reputation, right to keep privacy. So make sure that before you publish information related to someone else, you get proper authorization to do so.
3) While sharing Content on eu.DEEPTECH you grant FundingBox and its affiliates license to use it. It means that we might use the Content you provided for our purposes. The license you grants is:
a) unlimited with regard to territory and time (so we can use it wherever and whenever),
b) free of charge (you are not entitled to remuneration for use of the content),
c) non-exclusive (you can grant it to others),
d) with the right of sublicensing (we can grant further license),
e) permitting the use of Content in the following fields of exploitation, including in particular: recording, copying, performing in public, displaying, playing, broadcasting and publishing them in such a way that they are available to anyone at any discretionary place and time, in particular, in order to promote the operation of the eu.DEEPTECH Service.
4) In any case Content remains your property.
5) You also authorize FundingBox free of charge to place on the eu.DEEPTECH your name or trademark, or name or trademark of your company, or open call or project provided by it, in our information and promotional materials.
6) Above authorisation is effective upon sending this Content to the eu.DEEPTECH, in a way not limited with regard to territory and time.
7) You may not publish any elements of eu.DEEPTECH or Content provided by either Users, to which you don’t hold right, without our (or third party) prior written consent.
6. Community Guidelines
1) Remember that you are a Discord user and must follow the DISCORD COMMUNITY GUIDELINES.
2) Additionally, you must follow our community guidelines:
Respect & Kindness
- Be respectful towards all members, regardless of their background, beliefs, or opinions.
- Avoid personal attacks, harassment, hate speech, and discriminatory language.
- Remember, online interactions deserve the same courtesy as face-to-face ones.
Content & Communication
- Keep Content relevant to the chosen community.
- Avoid spamming, advertising, or posting NSFW Content (More about prohibited content Below).
- Use appropriate language and keep discussions civil and constructive.
- If you disagree with someone, do so respectfully and focus on the topic, not the person.
Community & Moderation
- Follow the designated channels and roles for relevant discussions.
- If you have questions or concerns, reach out to moderators or admins in a respectful manner.
Prohibited Content
3) It is prohibited to transmit illegal Content within the service, (including terrorist content) or content that violates the Terms, even if they are not illegal content. Content violating the Terms is:
a) create, upload, share or distribute any content that exploits or abuses children; this includes all child sexual abuse materials; if you believe a child is in danger of or has been subject to abuse, exploitation or trafficking, contact the police immediately and inform us;
b) promote, transmit, organize, or engage in activities that cause or might cause serious and immediate physical harm to people or animals, or share or distribute violent or gory content involving real-life people or animals that is primarily intended to be shocking, sensational, or gratuitous;
c) promote, transmit, organise, or engage in illegal activitiesunder any applicable law or regulation, including terrorism, human trafficking, sexual abuse;
d) create or distribute sexually explicit material, such as nudity, graphic sex acts, and pornographic content;
e) create or distribute content that is fraudulent, false, or misleading;
f) harass, bully or threaten others, or incite others in these activities;
g) promote or use hate speech (understood widely as content that promotes or condones violence against or has the primary purpose of inciting hatred against an individual or group on the basis of their race or ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or any other characteristic that is associated with systemic discrimination or marginalization);
h) transmit malware or any content that harms or interferes with the operation of the networks, servers, end user devices, or other infrastructure; this includes the direct hosting, embedding, or transmission of malware, viruses, destructive code or other harmful or unwanted software, or similar content, also content that transmits viruses, causes pop-us, attempts to install software without the user’s consent, or otherwise impacts users with malicious code;
i) spam,
j) abuse this Service and do harm, degrade, or negatively affect the operation of networks, devices, or other infrastructure; this includes degrading, disabling, or negatively interfering with any aspect of the Service or its features;
k) transmit through the Service any material that may infringe the intellectual property or other third party rights;
l) engage in any activity or use of the Service in any manner that could damage, disable, overburden, impair or otherwise interfere with or disrupt the Service, or any servers or networks connected to the Service or FundingBox security systems;
m) use the Service in violation of any applicable law.
4) You are not authorized to reproduce, resell, or distribute the Service unless specifically permitted to do so under a separate agreement with FundingBox.
7. Notice and action mechanisms
1) FundingBox does not:
a) use a scoring mechanism dedicated to finding infringement (illegal and/or offensive Content or behavior),
b) use automatic mechanisms to identify illegal Content/Content that violates the Terms,
c) verify previously posted Content (preventively) and the provider’s reaction only applies to Content that has already been posted,
d) carry out independent activities to monitor illegal or violating Content in accordance with Art. 7 DSA verifies the Content if a report is submitted,
e) carry out independent activities to monitor illegal Content in accordance with Art. 7 DSA
2) FundingBox may verify whether the posted Content is illegal or violates the Terms at any moment and/or when we receive a report of a violation of the Terms by any other User.
3) If the information provided by the User constitutes illegal Content or is inconsistent with the Terms, the Provider may:
a) remove or block access to Content,
b) limit the visibility of such information provided by the User, including removing Content, preventing access to Content or depositioning Content,
c) suspend for a period of 30 days or terminate the provision of the Service in whole or in part,
d) suspend for a period of 30 days or close the Users’s access to the eu.DEEPTECH Service.
4) Notice – information about illegal Content – can be reported directly to the Discord platform (via “Report Message” – Discord’s feature or to the FundingBox’ Legal Department – “legal @ fundingbox.com”.
5) If you want to notify illegal Content to FundingBox, you should include:
a) a sufficiently substantiated explanation of the reasons why the notifying person alleges the Content in question to be illegal Content,
b) a clear indication of the exact electronic location of that Content, such as the exact URL or URLs, and, where necessary, additional information enabling the identification of the illegal Content adapted to the type of Content and to the specific type of Service,
c) the name and email address of the notifying person submitting the Notice, except in the case of information considered to involve one of the offenses referred to in Articles 3 to 7 of Directive 2011/93/EU,
d) a statement confirming the bona fide belief of the notifying person submitting the notice that the information and allegations contained therein are accurate and complete.
6) If the FundingBox applies any of the restrictions mentioned above, we will provide the User with an appropriate justification referred to in Art. 17 section 3 DSA. Such justification will be sent by e-mail to the contact details of the Recipient.
7) If the Service is misused, FundingBox may take measures according to Art. 23 of DSA e.g. to suspend, for a reasonable period of time and after having issued a prior warning, in case frequently provide manifestly illegal Content and/or frequently submit Notices or complaints that are manifestly unfounded.
8. Final Provisions
1) FundingBox provides the hosting service referred to in Art. 3 letter g) of DSA – Content storage.
2) FundingBox does not provide an online platform service but Discord does – Content publish.
3) Transparency reporting obligations – FundingBox publishes the information referred to in Art. 15 DSA on fundingbox.com/trust/dsa/.
4) All privacy issues related to eu.DEEPTECH are described in FundingBox – Privacy Policy and Discord – Privacy Policy.
5) Should any of the provisions of these Terms be deemed invalid, illegal or unenforceable, then the validity of the remaining part of these Terms remains intact.
6) Within the eu.DEEPTECH, we use English as the official language. All documents are provided in English. All requests and complaints should also be in English. To the extent allowed by law, the English language version of this Contract is binding and possible translations are for convenience only.
7) To any matters not specified in these Terms, relevant provisions of the EU and Polish law shall apply. Polish law is also the governing law for liabilities resulting from the agreement and these Terms. For consumer rights please visit FundingBox – Consumer rights page.
